Because mfg does not mechanically limit the top speed to 70mph, there is a probability people will drive faster than 70mph. To maximize profit, manufacturers need to balance the cost of mfg liability and the cost of design/engineering/manufacturing. So the car ends up meeting performance and safty requirements at a speed somewhere between 70 and 120, driven by an average driver. So there must be still some degree of over engineering, compared to a car that can not go faster than 70mph. It's all probability.
